Council Appeals Kwallu’s Judgment, Insist Abdukmalik Remains Substantive Chairman Of Qua’anPan LGA

Sequel to the judgment delivered on the 17th September, 2021 at Plateau state High Court which was presided over by justice N.L. Musa in favour of Hon. Isaac Kyalle Kwallu as chairman of Qua’anPan Local Government Area, the Council bemoaned the court decision and insist that Hon. Abdukmalik Haruna remain substantive chairman of the council.

The Council said that they have already appeal the judgment at Appellant Court in Jos division.

The decision of Qua’anPan Local Government was contained in a press statement signed by it’s Council Secretary, Barr. Simon Dawang on Saturday 18th September,2021.

According to Dawang:”On the 17th day of September 2021, the High Court of Justice Plateau State presided over by Justice N.L Musa delivered it’s verdict in the case instituted by Isaac Kyalle Kwallu against the council chairman, Hon.Abdulmalik Haruna, all the members of the legislative arm of the council, the Plateau State House of Assembly amongst other Agencies of Government to challenge his removal from office.

“The court granted the reliefs sought by the Plaintiff. We have since been informed that being dissatisfied with the said judgement, the Council Chairman and all other persons adversely affected have since lodged their respective appeals through their lawyers against the said judgement to the Court of Appeal Jos Judicial Division in furtherance of the exercise of their constitutional rights.

“They have further filed motions to stay the execution of the said judgement and same is now pending before the same Justice N.L Musa awaiting a determination before any step can be taken to enforce the judgement.

“In the circumstance therefore we urge all peace loving people within the Local Government Area to shun acts of incitement and go about their lawful businesses and to await the time when the judicial process at the Court of Appeal will be exhausted in line with the settled principles of law.

“The public may wish to note that the High Court which delivered the judgement against the Council Chairman, other officers of council, House of Assembly and other agencies of Government as presided over by Justice N.L Musa is only a Court of first instance in the hierarchy of Courts in Nigeria. It’s decision is not infallible and as such liable to be tested on appeal to determine its correctness or otherwise.

“In order to put the record straight, Hon. Yusuf Haruna Abdulmalik remains the substantive chairman of Qua’an Pan Local Government Council pending the determination of the Appeal lodged against the decision of the trial court.

“The chairman therefore calls on all his supporters to remain calm and law abiding.
